Terms and Conditions of Use — Best Crédit
Best Crédit · September 2026 These Terms apply to all users of the Best Crédit platform (best-credit.net).
Preamble
Best Crédit is a platform that connects people seeking financing (“Borrowers”) with funders licensed in Tunisia (“Funders”): banks, leasing companies, microfinance institutions and other bodies authorised under Tunisian regulations.
Best Crédit acts exclusively as a technical intermediary: the platform neither collects nor handles any funds, grants no credit, guarantees no offer and is not a party to any financing contract that may be concluded between a Borrower and a Funder.
Creating an account entails full and unreserved acceptance of these Terms.
Article 1 — Publisher of the platform
The platform is published by STE YASA DE DEVELOPPEMENT DIGITAL SARL, a limited liability company with share capital of 5,000 TD, whose registered office is at Avenue Farhat HACHED — Sidi Abdelhamid, 4000 Sousse Médina, Tunisia, unique identifier: 1680871H.

Article 2 — Definitions
- Borrower: a natural or legal person publishing a financing request.
- Funder: a licensed financing institution, verified by the platform (KYB check), acting through its authorised members.
- Request: a financing need published in anonymised form on the market.
- Offer: a financing proposal submitted by a Funder on a Request (amount, term, fees, conditions and, depending on its regime: the credit rate (nominal annual) and the processing fee, or a Sharia-compliant contract with a margin or profit sharing).
- Financing regime: the preference expressed by the Borrower at submission — conventional, Sharia-compliant, or no preference — and carried by each Offer. This choice constitutes a financial product preference; it amounts to no declaration of belief and to no religious commitment, by anyone.
- Confidentiality matrix: the mechanism by which the Borrower decides, access by access, what each Funder may view (anonymised card → declared summary → full file).
- Full file: the Borrower's contact details and supporting documents, opened read-only to a Funder upon explicit grant.
Article 3 — Purpose and scope of the service
The service consists in: publishing anonymised Requests; allowing verified Funders to view them and submit competing Offers; allowing the Borrower to compare, shortlist, accept or decline those Offers; and opening supervised messaging between the parties.
Best Crédit is not a credit institution within the meaning of Law no. 2016-48 on banks and financial institutions, provides no advice on investment or credit, and receives no funds on behalf of users. Each Funder alone remains subject to its own prudential regulation and licensing obligations.
Honour loans (قرض على الشرف) within the meaning of article 412 ter of the Commercial Code (Law no. 41-2024) and Decree no. 2026-148 of 23 July 2026 are excluded from the scope of the Platform: such financing is handled exclusively on the banks' own platforms, with which applications must be filed directly. No Request or Offer published on the Platform may relate to this scheme; a permanent notice recalls this under the site header.
The service is entirely free for Borrowers: neither registration, nor publishing a Request, nor receiving and comparing Offers, nor messaging is charged to them — at no time and in no form. Best Crédit never receives any payment from a Borrower; any request for payment made in the platform's name is a fraud, to be reported immediately (Contact page). Best Crédit's remuneration comes exclusively from services provided to Funders, on terms contracted directly with them.
Article 4 — Registration and accounts
Registration is restricted to persons of full age and legal capacity. Users undertake to provide accurate, complete and up-to-date information. Sign-in uses a one-time code sent by email; submitting a Request requires a verified Tunisian phone number (by SMS). Enabling two-step verification (2FA) is strongly recommended, and is required for certain sensitive actions when it is enabled.
Each person may hold only one account. Best Crédit may suspend any account in the event of a breach of these Terms.
Article 5 — Financing requests
A Request specifies in particular the type and the financing regime sought, the amount, the term, the purpose, the governorate, as well as the declared total project cost; the regime and, where declared, the total cost together with the resulting financed share appear on the anonymised listing. The Borrower warrants the accuracy of their declarations and the authenticity of the documents uploaded. Requests are subject to caps, quotas and anti-abuse checks (amount and term limits, number of requests per period, a single active request per financing type).
The “student” profile requires the designation of a guarantor and the upload of their supporting documents. In accordance with due-diligence obligations, the persons concerned are screened against international sanctions lists; a significant result places the request under manual review by the compliance team, with no automatic publication.
Article 6 — Funders and authorised members
Access to the Request market is restricted to institutions that have passed the platform's KYB verification. The platform creates the organisation and onboards its first member, with the super admin role — a single one and the governance lead, who cannot be removed or changed from the interface (transferring the role rests with the platform, on request). The organisation then manages its own team: the super admin and the admins may add members (whose account must already exist), change roles (admin or analyst) and remove members — the super admin remains in all cases. The analyst role works the market (viewing, offers, messaging) but has access neither to team management nor to changing the targeting choices; those targeting choices rest with the super admin alone, who may moreover restrict each member to certain governorates, within the limits of their own scope. The super admin may also require two-step verification from all members of the organisation. These governance operations are sensitive actions (the 2FA challenge is required when the protection is enabled). Each Funder remains responsible for the members it authorises. Member accounts use a professional email address; Best Crédit reserves the right to delete member accounts using a non-professional address.
Information obtained through the platform (including the full file when granted) is strictly reserved for the assessment of the Request concerned. The following are prohibited: reusing it for other purposes, passing it on to third parties, and any off-platform solicitation of a Borrower identified through Best Crédit without a prior grant of the full file.
Article 7 — Offers, comparison and acceptance
Each Offer shows in particular the amount, the term, the file fees, its validity period, its special conditions and, depending on its regime: for a conventional Offer, the credit rate (nominal annual), the processing fee, the effective rate excluding insurance and the estimated monthly instalment; for a Sharia-compliant Offer with a schedule (Murabaha, Ijara, Musawama, Istisna'a, or Qard Hassan — the latter with no margin by construction), the contract and the margin, with fixed instalments — never a rate; for a participative Offer (Musharaka, Mudaraba), the contract and the profit sharing, with no schedule and no guaranteed return: its conditions rest with the contract concluded off-platform and Best Crédit neither guarantees nor promises any return. Estimated amounts are calculated by the platform, which is authoritative for display purposes. Offers with a schedule undergo, before publication, an excessive-rate check within the meaning of Law no. 99-64, based on the caps published by the Central Bank of Tunisia and entered by the platform: the outcome of this check is logged and brought to the Funder's attention — the regulatory compliance of the Offer is the sole responsibility of the issuing Funder. For Sharia-compliant Offers with a schedule, this check applies to the effective rate excluding insurance of the margin (processing fee included), computed and retained by the platform for regulatory compliance purposes only — it is not displayed as a feature of the Offer. The Sharia compliance of an Offer rests exclusively with the competent board of the issuing institution: Best Crédit issues no religious opinion and delivers no certification.
A Borrower's acceptance of an Offer: automatically declines competing Offers; opens the full file to the selected Funder (read-only, access logged); and exchanges mutual contact details. Acceptance on the platform does not constitute conclusion of the credit contract: the latter is processed, concluded and performed directly between the Borrower and the Funder, off-platform, according to the Funder's own procedures (the Funder remaining free in its final decision after assessing the file).
Article 8 — Confidentiality matrix
The financing types that may be requested depend on the Borrower's declared profile (a consistency matrix applied at submission; earlier Requests remain valid). Requests are published anonymised. Any extension of access rests with the Borrower's sole decision, taken from their request page, on a graduated scale: the Funder may express interest, and the Borrower then chooses to grant the declared summary (country of residence, income currency, scheme where applicable, declared monthly income, or annual turnover for a legal entity — never identity or documents), to grant the full file (contact details, guarantor and documents read-only, through temporary links), to decline, or to revoke an access already granted at any time (with immediate effect). Each decision applies to the Funder concerned alone, is logged and revocable. The only exception, and it is express: accepting an Offer automatically opens the full file to the selected Funder (article above). The instalments and costs shown on Offers are calculated by the platform for guidance (credit rate or margin depending on the regime, term, processing fee as declared by the Funder; BCT excessive-rate pre-check on the effective rate excluding insurance — which is not the statutory annual percentage rate, that being a matter for the Funder's contractual offer) — the final contractual amounts are provided by the selected Funder in the contract concluded off-platform. Symmetrically, access ends automatically when the Request concludes: upon acceptance of an Offer (for the Funders not selected), upon withdrawal of the Request by the Borrower, or upon its expiry.
The Borrower may withdraw their Request at any time while it has not been fulfilled; withdrawal is final: the Request leaves the market, pending Offers are declined and all granted access ends, with those concerned being informed. A published Request that goes 90 days without receiving a single Offer expires automatically (it leaves the market, the Borrower is informed and may create a new one). The platform itself never lifts these protections for the benefit of a Funder; its administrators access them only for compliance, moderation and support purposes.
Article 9 — Messaging and moderation
Messaging opens once the Funder has submitted an Offer, or as soon as the Borrower grants them access (summary or full file). Until the full file has been granted, contact details (phone numbers, emails, links) exchanged in messages are automatically masked. The following are notably prohibited in exchanges: promises of a “guaranteed rate” or of “risk-free” credit, requests for advance fees, and any means of circumventing the platform. Messages in breach may be blocked automatically; any participant may report a thread to moderation, which may sanction the accounts at fault.
Article 10 — Obligations and prohibited conduct
The following are prohibited, without this list being exhaustive: document fraud and false declarations; impersonation; the creation of multiple accounts; any attempt at unauthorised access to another person's data; use of the platform for money laundering, unlawful financing or purposes contrary to Tunisian public order.
Article 11 — Liability
Best Crédit is bound by an obligation of means as regards the availability and security of the service. The platform guarantees neither the solvency of Borrowers, nor the ultimate seriousness of Offers, nor the final granting of financing, and assumes no liability in respect of the credit contract concluded — or not — between the parties. A loan commits you and must be repaid; the Borrower must check their repayment capacity before any commitment. As regards participative Offers, the platform neither formulates nor relays any promise of return; as regards Sharia-compliant Offers, it issues no religious opinion or certification, such compliance resting with the issuing institution alone.
Article 12 — Personal data
Data processing is described in the Privacy policy, drawn up in the light of Organic Law no. 2004-63 on the protection of personal data and of the requirements of the INPDP.
Article 13 — Intellectual property
The platform, its brand, its interface and its contents are protected. Any unauthorised reproduction or extraction is prohibited. Content published by users remains theirs; they grant the platform the licence strictly necessary to operate the service.
Article 14 — Suspension and termination
Users may stop using the service and request deletion of their account at any time (contact@best-credit.net). The platform may suspend or terminate an account in the event of a serious or repeated breach of these Terms, or where a legal obligation so requires, subject to retention imposed by law.
Article 15 — Amendment of the Terms
These Terms may change. The applicable version is the one published on this page on the date of use; substantial changes are brought to users' attention by any appropriate means.
Article 16 — Governing law and disputes
These Terms are governed by Tunisian law. In the event of a disagreement, the parties shall first seek an amicable solution (contact@best-credit.net). Failing that, jurisdiction is conferred on the courts of Sousse, subject to mandatory rules of jurisdiction.
